3. ORIGINAL TEXTS AND COMMENTARIES

The Institutes of Gaius—This work is available in many English translations. A useful recent translation with corresponding Latin text and vocabulary is, Gordon, W. M. and Robinson, O. F. (1988), The Institutes of Gaius, London: Duckworth. An older, yet equally useful translation is de Zulueta, F. (1946-53), The institutes of Gaius, Text, Translation and Commentary, Oxford: Clarendon Press, de Zulueta's detailed commentary on individual texts in the second part of this work is a testament to the genius of this scholar and remains extremely useful, despite its age.

The Institutes of Justinian—English translations of this work include, Moyle, J. B. (various editions), The Institutes of Justinian, Oxford: Clarendon Press, a two-volume set consisting of the Latin text with a thorough commentary in the footnotes in volume 1 and an English translation in volume 2; Lee, R. W. (1952), Elements of Roman Law, London: Sweet & Maxwell; and Thomas, J. A. C. (1975), Justinian's Institutes, text, translation and commentary, Amsterdam: North-Holland Publishing Co. A useful recent translation with corresponding Latin text is, Birks, P. and McLeod, G. (1987), Justinian's Institutes Translated With an Introduction, London: Duckworth. The introduction to this translation contains many useful insights, particularly concerning the institutional scheme and its importance in European legal history. To this list should be added Metzger, E. (ed.) (1998), A Companion to Justinian's Institutes, London: Duckworth. This work contains a detailed commentary on individual texts of the Institutes by many of the foremost Scottish Romanists.

The Digest and the Code—The most recent English translation is that of Watson, A. (ed.) (1985), Justinian's Digest, text by T. Mommsen with the aid of P. Krueger, Philadelphia: University of Pennsylvania Press. Although this work has been criticized for its 'Americanisms', it remains an indispensable teaching tool, since the quality of the translations is overall much better than the dubious attempts in Scott, S. P. (1932), The Civil Law, Cincinnati: The Central Trust Company. There is an excellent modern English translation of Justinian's Codex to be found online at: http://www.uwyo.edu/lawlib/ blume-justinian/. While an attempt was made in Scott's Civil Law, the translation should be approached with caution.

The Theodosian Code and the Novels—The standard English translation is Pharr, C. (ed.) (1952), The Theodosian Code and Novels: and the Sirmondian Constitutions—A Translation with

Commentary, Glossary, and Bibliography, Princeton, NJ: Princeton University Press, The main drawback of this translation is that the corresponding Greek and Latin texts have not been included. An English translation of the Novels maybe found at http://uwacadvreb.uwyo.edu/ blume&justinian/default.asp

It is not the purpose of this work to provide a comprehensive instruction manual for those wishing to engage in Roman-law research, but it is worth noting that many recent works on the external legal history of Roman law contain excellent accounts of the use of non- legal sources. On the nature and location of these sources, see Robinson, Sources, 66-73 and Mousourakis, Historical and Institutional Context, 6-16 (especially the footnotes). For a survey of the literary and epigraphic sources of each period in the historical evolution of Roman law, see Tellegen-Couperus, Short History, s. 1.1 (Archaic law), s. 4.1 (Late Republic), s. 7.1 (Principate), s. 10,1 (Dominate). Nearly all of the literary sources (Greek and Latin) are available in translation (with corresponding text) in the Loeb Classical Library Series. Translations appearing in older editions of this series should be approached with great care, since they tend to be rather florid and somewhat inaccurate.
