Appendix A Karl Llewellyn on Legal Advocacy
This book refers repeatedly to the advice about advocacy that one of law’s juggernauts, Karl Llewellyn, offered in 1957. Llewellyn is one of law’s titans, having drafted the Uniform Commercial Code, shaped legal realism, and written the legendary Bramble Bush.
Toward the end of his career, he also offered some confidential advice about advocacy to his students. The advice has never been published until now.I learned of this document from my dean, Robert Post, who forwarded it to me with a short message that captures my view:
I just came across these materials in my office. Best advice on legal writing I’ve ever seen.
I reprint this advice with the permission of Professor Llewellyn’s nieces, Sandy Mentschikoff Levedahl and Jeanne Mentschikoff. They expressed interest in preserving their uncle’s legacy and ensuring that his insights continue to inspire students and practitioners. May it be so.
